FiscalNote, Inc. (“FiscalNote,” “we,” “us,” or “our”) provides messaging capabilities through its software platforms and services. These platforms may enable organizations to communicate with individuals via SMS or other messaging channels (“Messaging Services”).
This Messaging Policy outlines the rules and standards that apply to Messaging Services operated by FiscalNote or through FiscalNote platforms.
This policy applies to:
- FiscalNote messaging programs; and
- messaging programs operated by FiscalNote on behalf of clients or organizations using FiscalNote platforms.
All messaging activity must comply with applicable law, industry standards, and this policy.
- Consent and Opt-In Requirements
Messaging programs must operate on a consent-based model.
Before sending SMS messages, the recipient must provide clear consent (opt-in). Consent may be obtained through:
- web forms or advocacy tools
- event registrations
- account sign-ups
- campaign participation pages
- other clear opt-in mechanisms
Consent must clearly disclose:
- the identity of the sender or sponsoring organization
- the purpose of the messages
- that SMS messages will be sent
Consent cannot be obtained by purchasing or renting phone lists or other third-party data sources.
- Sender Identification
All messaging programs must clearly identify the sender.
When Messaging Services are operated through FiscalNote platforms:
- the message sender may be a client organization
- FiscalNote may operate the program on behalf of that organization
The sponsoring organization or campaign should be identifiable at the time of opt-in and within messaging communications where appropriate.
- Message Content and Program Transparency
Messaging Programs must clearly disclose key program information, including:
- program or organization name
- a brief description of the program
- expected message frequency (or that frequency may vary)
- customer support contact information
- instructions for opting out of messages
Message and data rates may apply depending on the recipient’s mobile carrier and plan.
- Opt-Out Requirements
Recipients must be able to opt out of Messaging Programs at any time.
Recipients may unsubscribe from SMS messages by replying: STOP
Once a recipient opts out, they will no longer receive SMS messages from that program unless they subsequently opt in again.
Industry messaging standards require that systems support keywords such as STOP and HELP for opt-out and support requests.

- Messaging Practices
Messaging Programs must comply with applicable legal and industry standards, including those related to:
- the Telephone Consumer Protection Act (TCPA)
- CTIA messaging guidelines
- mobile carrier messaging requirements
Messaging Programs must not:
- send unsolicited messages
- misrepresent the identity of the sender
- use deceptive or misleading messaging practices
- attempt to evade carrier spam filtering mechanisms
Recipients who opt out must not receive additional messages unless they opt in again.
- Privacy
FiscalNote processes personal information associated with Messaging Services in accordance with its Privacy Policy.
Information collected in connection with Messaging Programs may include:
- mobile phone numbers
- messaging interactions
- opt-in and opt-out records
This information is used to operate messaging programs and provide related services.
SMS consent and phone numbers are not shared with third parties or affiliates for marketing purposes.
When FiscalNote operates Messaging Programs on behalf of client organizations, those organizations may also process recipient information in connection with the program.
- Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
- Compliance and Enforcement
FiscalNote reserves the right to monitor messaging activity conducted through its platforms.
Messaging Programs that violate applicable law, carrier policies, or this Messaging Policy may be suspended or terminated.
Organizations using FiscalNote platforms are responsible for ensuring that their messaging activities comply with:
- applicable laws and regulations
- mobile carrier requirements
- this Messaging Policy
- Policy Updates
FiscalNote may update this Messaging Policy from time to time. Updates will be posted on this page with a revised effective date.
